Selling or Buying Property in Israel From Abroad

Selling your apartment in Tel Aviv while you live in New York? Buying a home in Jerusalem from London? With the right power of attorney, your representative in Israel can sign and complete the deal for you – and you stay in control of the terms.

How we help

  • Advise which power of attorney the deal needs – special, and in many cases irrevocable
  • Draft the document so it fits the transaction and is acceptable to the Land Registry, the bank and the other side
  • Guide you through signing before an Israeli consul or a local notary with an apostille
  • Coordinate with your Israeli real-estate lawyer

Why the type of POA matters

In a sale or purchase, the other side usually wants certainty that the deal can be completed. That's why an irrevocable power of attorney is common in Israeli property transactions. It protects the deal – but it also means you can't simply cancel it, so it should be precise and limited to that property and that transaction.

Taxes and reporting

Property sales and purchases in Israel generally involve reporting to the Israel Tax Authority and may involve betterment tax (mas shevach) or purchase tax (mas rechisha). Whether tax is due, and how much, depends on your circumstances – we'll make sure the power of attorney also covers the necessary filings.

Common questions

Do I have to come to Israel to sell my apartment?

In most cases, no. With a properly signed power of attorney, your representative can sign for you.

Can my relative in Israel be my representative?

Yes, you can choose a person you trust. Many clients appoint a lawyer as well, or instead, to make sure everything is done correctly.

Can I limit what my representative may do?

Yes. A special power of attorney can be limited to a specific property, a minimum price, a time period and specific actions.
