Enduring (Lasting) Power of Attorney in Israel

An enduring power of attorney (yipui koach mitmasheich) lets you decide, while you are able to, who will take care of your affairs if one day you can no longer do so – for example because of illness or old age. It was introduced into Israeli law in 2017 as an alternative to court-appointed guardianship.

What it can cover

  • Property and financial matters
  • Personal matters
  • Medical matters

You can choose one or more of these, appoint more than one person, and give instructions about your wishes.

Special requirements

Israeli law sets strict rules: the document must be prepared and signed in the presence of a lawyer who has completed special training by the Administrator General, and it is deposited with the Administrator General. Because of these requirements, the options for people living abroad are more limited than for a regular power of attorney. We'll explain what is currently possible in your situation.

Adv. Rachel Shachar is qualified to prepare enduring powers of attorney. Note that Israeli consulates do not certify enduring powers of attorney, so this is not something you can do at an embassy. Is it for me?

Many Israelis abroad still own property, accounts or pension rights in Israel, or have elderly parents here. Planning ahead can save your family a difficult and lengthy court process.

Common questions

Is an enduring POA the same as a regular POA?

No. A regular POA is usually for a specific action now. An enduring POA is designed to come into effect in the future, when you are no longer able to make decisions.

Can I cancel it?

Generally, yes, while you still have capacity, following the procedure set out in the law.

Can I sign it outside Israel?

This depends on the current rules and your circumstances. Please contact us and we'll explain the available options.
